I'd say yes, unless maybe you're someplace that requires emissions testing/inspection. They won't be able to "inspect" for jet valves, but if they require all-stock equipment including a stock carb, you might not pass the tailpipe sniff test w/o functional jet valves.
That said, we have emissions checks here, but they only inspect for a cat, gas cap that seals, and functional secondary-air system (injects fresh air into the exhaust stream), and I've had no trouble passing the tailpipe sniff with my Weber carb that doesn't use the jet valves at all. Speaking of, if you already have (or plan to get) a Weber carb, just go for the non-jet head.
