Damn uninsured driver took out my Mighty Max

Postby FordTruckMan » Fri Aug 06, 2010 6:41 pm

Well, I was driving home last night from work when at midnight A mercedes M50 Suv pulled out in front of my Mighty Max and then swerved back into my lane and took me out. Convienantly she had insurance but it expired 6 days ago so they basically told me to shove it. My complete front end is smashed up but my frame isnt bent and my radiator isnt busted. I will need to replace my hood, grill, lights, bumper, valance, driver side fender and a wheel that got bent, and my tie rod broke. Got my work cut out for me both in the court and working on my truck. Should have her back on the road in a few weeks hope.

A Mercedes --- Well get a lawer and sue them untell you have everything they have. Unless there is a law that says you don't need insurance.. I know that it is not leagle in Ca to drive with out it. There fore it should have never happend in the first place. That sucks dude. You can send it to me for a complete transformation into somthing out of the movie Mad Max...

Oh, the police did show up, called 911. Had to have my truck towed away, the engine runs but it aint going anywhere. The cop pulled her plates and hit her up with like 3 citations. But that still doesnt exactly help me out with the insurance problem. I was thinking the same thing, owning me a mercedes would be kinda nice, sure its kinda dented up now but no worse than my mighty max.

You'll probably have to take her to small claims court and you'll probably win, but it doesn't guarantee that she'll pay up. I'd start the process and see if she will pay up before it goes that far. If she lapsed on her insurance it maybe a sign of money troubles though.

This caught my eye. At a recent lunch with a number of friends, TWO of them mentioned this very thing. One had a child's car get hit and another had a friend get hit. One was a fender-bender and the other was like FordTruckMan's, only more so (no injuries, fortunately).
One settled for cash, out of court, and the other uninsured driver is being sued by the driver's insurance company.
In MO, proof of insurance is required for annual/biannual auto license procurement - but my insurance agent said that many people cancel right after getting the plate - and, it's been happening more and more over the last two years.

Yeah, I'm starting on the process already trust me. I'm hoping she will settle out of court but I highly doubt it. I will keep you guys up to date on whats happening, My Max will be back on the street soon, and I went to go get my parts truck today which currently is in better shape than my daily driver.

dude nail her to the wall in court. eather small claims or pay 250 and take her to big boy court. If she has a house or a bank account you can take it. I have seazed bank accounts of companys that owed me money. One company owed me $5000 bucks. They do million dollar jobs with the state of California. I won in small claimes. They tryed to dick me around after words. They found out that the little guy that knows the law can stop the big dog and there 5 lawers. First I sent a copy to the state controlers office that they had an outstanding judgment they needed to pay. This shut down the money flow from the 60 million dollar job from Caltrans they were on. Work stopped on the freeway after 2 days. You should have herd them bitch about that. Ha Ha.. But they did not want to send me a check. They wanted me to signe a release form first. F-U. It don't work that way. Then I draged them back to court for an examination. Wanted bank account numbers. They supplied me with the papers of that, and all there equiptment along with storage yards. Pretty much all there assets. I gave them 7 more days. Now a letter comes from them saying they will sue me for the injuction on there job. F-U. You owe me..... So I went to the police and had a deputy meat me at the bank and serve papers to the bank to freeze there accounts. ALL 16 of them... Ha Ha... Now they were S---ed No payrole, bouncing BIG checks to venders and so on. Well I had 30 days to remove the money they owed me. I could have done it right then and there but NO..... I'm a Asshole,,, when you use my stuff and screw it up, then tell me to go screw my self well thats the wrong thing to do. The account totals were huge. They had money like it was no bodys business.. Right at 62.53 Million. Holey crap. All they need to do was send me $5000. for the repairs to my stuff. So at 28 days I came back to the B of A and got my $5000 along with the $250 for the police fees and released the account. Then released the leans on there jobs. To this day I never got an applogy from them. But I did get to rattle there cage and screw them on future jobs with the state and venders don't trust them... Ha Ha I win..... F--- YOU Serrano..

Nice, Thats awsome. Well I went to dealership today so I could get some nice outrageous prices on parts. comes to about $2600. :D And thats what I'm asking for. But thats not it, I'm gonna get me some lost of wages, labor, fuel surcharges, maybe a holding fee for my yard. But yeah I'm not just gonna let this go, no, I like my Mighty Max. Grown to like the little thing so much that I now have 2 1992's. I'm gettin it fixed and within a matter of weeks it will be back on the street. And then I can finally get to start on my frame work and get my bags and stuff. And HEY, I might just own me a Mercedes too.
